I am seeking an attorney who is willing to handle my case on a pro bono
basis. My family has exhausted their funds in their attempt to procure my
release. I will be the first to admit that I am a man who has committed
mistakes in my life. However, the sentences I am now incarcerated for
are unjust and nothing more than cruel and unjust punishment.
I am currently doing
Life without any expectation of parole, probation, or suspension of
sentence for kidnapping, which was really a carjacking. There were no
injuries to either of the two victims, and, as a matter of record, the two
victims were allowed to exit the vehicle and enter a convenience store,
without any resistance. In most other states, if the victims are released
unharmed, they automatically drop the charges to a lower grade of
kidnapping. However, in Louisiana, because a "ride' is considered
something of value, the state chose to upgrade the 2nd Degree
Kidnapping to Aggravated Kidnapping and they imposed a life sentence.
Since
being incarcerated, I have graduated from New Orleans Baptist
Theological Seminary, Leauwell Extension Center here at Angola,
obtaining my Associates Degree and Bachelor of Arts in Christian
Ministry. I am a part of the Hospice Program and go to the hospital on a
regular basis, performing various tasks for the guys on the ward such as
reading Scriptures, writing letters, making beds, or a lot of times, simply
listening to a scared man who is dying. It's not much, but its the best I can
do being that I have been blessed with my health. Currently i am enrolled
in Vocational School here furthering my welding abilities, about to enter my
third semester (May, 2008).
As one can see, I am not the same person I was when I committed the
instant crimes. The title "Department of Corrections" carries with it a
connotation of "rehabilitation" and/or "correction". When on victims are
harmed, the imposition of a life sentence, which is supposed to be limited
to the most severe and egregious offenders, is nothing more than the
purposeful imposition of pain and suffering and is grossly out of
proportion to the severity of the crime and makes no measurable
contribution to acceptable goals of punishment. The brief specifics of my
case are as follows:
Crime Committed: February 3, 1998
Arrest date: March 24, 1998
Original Charges: Two counts of Armed Robbery and Two counts of
2nd Degree Kidnapping ( Fifteen months later, both kidnappings
were upgraded and amended to Aggravated Kidnapping)
Jury trial: June, 2000 trial lasted for three days. Was found guilty of all
four counts in just 14 minutes. Sentenced to serve 2 life sentences
for the Aggravated Kidnappings charges, 20 years for one Armed
Robbery, and 30years for the other. The Judge ran both Life
sentences and the 20 years concurrently, but ordered the 30 year
sentence to be run consecutively. I'm under act. 150 -- all time day
for day -- flat.
I have timely filed a direct appeal, post-conviction relief, and am
currently awaiting a ruling on my Federal Habeas Corpus, which has been
pending since May of 2005.
Issues raised: Grand Jury Indictment is invalid; wore shackles
throughout jury selection and trial; ineffective assistance of counsel; other
crimes evidence, and double jeopardy
